When This Applies
This Consumer Terms Schedule (“Schedule”) applies when you are a Consumer - that is, a natural person using DroneDB Services for purposes that are outside your trade, business, craft, or profession.
This Schedule is read together with the Cloud Services Agreement (“Agreement”). Where this Schedule conflicts with the Agreement, the provisions of this Schedule prevail to the extent required by mandatory consumer protection law.
If you are using the Services on behalf of a business, organization, or in a professional capacity, this Schedule does not apply and the general terms of the Agreement govern.
Consumer Supremacy
Nothing in this Schedule, the Agreement, or any other communication from Digipa S.R.L. limits, restricts, or excludes any right, protection, or remedy that cannot lawfully be limited under:
- The Italian Consumer Code (Legislative Decree no. 206/2005, as amended)
- Applicable European Union consumer protection directives and regulations
- Other mandatory provisions of law protecting consumers in your jurisdiction
If any provision of these terms is found to be in conflict with mandatory consumer law, that provision shall be treated as modified to the minimum extent necessary to comply with the law, and the remainder of the terms shall remain in effect.
Right of Withdrawal
14-Day Withdrawal Right
Under Directive 2011/83/EU (Article 9) and the Italian Consumer Code, you have the right to withdraw from your subscription contract within 14 days without giving any reason.
The 14-day period starts from the day the contract is concluded.
To exercise your right of withdrawal, you must inform us of your decision by any clear statement - for example, by visiting the online withdrawal form or by sending an email to support@dronedb.app - before the withdrawal period has expired.
Model Withdrawal Form
You may use the following model withdrawal form (leaving blank any fields you do not wish to complete):
(1) Delete as applicable. (2) Signature and date only required where the form is signed on paper.
Online Withdrawal Function
In accordance with Directive (EU) 2023/2673, you may exercise your right of withdrawal using the online withdrawal form. You may also send a withdrawal notice by email to support@dronedb.app.
Effects of Withdrawal
If you exercise your right of withdrawal, we will refund all payments received from you using the same means of payment as used for your original transaction (unless you expressly agree otherwise), without undue delay and no later than 14 days from the day we receive your withdrawal notice. You will not incur any fee for the refund.
Performance During the Withdrawal Period
1. Services (Art. 14(3) of Directive 2011/83/EU): Where the subscription services have begun to be performed during the 14-day withdrawal period with your prior express consent and your acknowledgment that you thereby lose your right of withdrawal, the right of withdrawal may be excluded for the portion of Services already performed. Where services are continuously supplied (such as a monthly subscription), you remain liable for the proportionate value of the Services provided up to the point of withdrawal, calculated in proportion to the total service period contracted for.
2. Digital content (Art. 16(m) of Directive 2011/83/EU): Where you have downloaded, streamed, or otherwise received non-contracted digital content during the withdrawal period, any deterioration in value of the content resulting from using it beyond what is necessary to establish its nature, characteristics, and functioning will be your responsibility.
Digital Service Conformity
Under Directive (EU) 2019/770 on digital content and digital services:
Conformity Obligations
The digital services we provide must conform to the contract throughout the period of continuous supply. At a minimum, the Services must:
- Be fit for the purpose ordinarily expected of a geospatial data management platform of the type described on the Site and in your Plan details.
- Match the description and functional specifications published for your Plan.
- Perform to the standard a reasonable consumer would expect, taking into account the nature of the Services and any public statements made by Digipa regarding specific characteristics.
Remedies for Non-Conformity
If the Services do not conform to the contract, you have the right to request that the non-conformity be remedied, in accordance with Italian consumer law. Available remedies may include:
- Repair or Correction: We will work to resolve the non-conformity.
- Price Reduction: If the non-conformity cannot be promptly remedied, you may be entitled to a reasonable reduction in the price you pay.
- Termination: In cases of substantial non-conformity that cannot be remedied, you may be entitled to terminate the contract and receive a refund.
Please contact support@dronedb.app to report any non-conformity. We will work with you to resolve the issue.
Non-conformity that arises because you or a third party modifies the Services, uses them in a manner contrary to our guidance, or relies on user-generated content or third-party integrations may not be covered.
Liability: Consumers
Mandatory Protections
Your statutory rights as a consumer cannot be limited, waived, or excluded by these terms. Any liability cap or exclusion in the Cloud Services Agreement that would reduce protections afforded by mandatory consumer law does not apply to you.
Scope of Liability
To the extent permitted by mandatory consumer law, our liability is limited to damages that were foreseeable at the time the contract was concluded. Claims must be reported within a reasonable time after you become aware, or ought to have become aware, of the issue.
Product vs. Service
The liability provisions for digital services apply to the Hub and subscription features. The DroneDB Desktop application, where distributed as software (a digital product), may be subject to separate conformity and liability rules under Directive 2019/771 (sale of goods) or Directive 2019/770 (digital content), depending on how it is provided to you.
Jurisdiction: Consumers
You may bring legal proceedings against Digipa in the courts of your habitual residence, your domicile, or the place where you received the Services. This right cannot be contracted away or limited by these terms.
This is in accordance with Regulation (EU) No 1215/2012 (Brussels I bis), Article 17, and corresponding provisions of the Italian Consumer Code.
Digipa may bring proceedings against you only in the courts of the Member State where you are domiciled.
Alternative Dispute Resolution
If you have a complaint regarding these terms or the Services, we encourage you to contact us directly at support@dronedb.app so that we can attempt to resolve it in a timely and friendly manner.
Where direct resolution is not possible, you may be entitled to use an alternative dispute resolution (ADR) mechanism under applicable consumer protection law. For consumer disputes arising from this Agreement, the Camera di Commercio di Milano (Milan Chamber of Commerce, Commercial Arbitration Center) may be approached for mediation or arbitration services. Digipa S.R.L. shall confirm its participation status and any specific procedural requirements in the final published version following Italian counsel review.
You may also contact your local consumer protection association for assistance. The EU Online Dispute Resolution platform (ec.europa.eu/odr) was discontinued on 20 July 2025 and is no longer operational.
Recurring Subscriptions
Transparency at Checkout
Before you confirm a recurring subscription, we will clearly display:
- The total price per billing cycle, including taxes.
- The billing frequency (monthly or annual).
- That the subscription will automatically renew unless you cancel.
- How to cancel the subscription.
- For free trials: All trials last 30 days. Payment information is required to begin a trial. Your card will be charged at the end of the trial period unless you cancel before that date. The confirmation button will clearly indicate “You have an obligation to pay [amount] per [period] after your trial ends” as required by Article 22g of Directive (EU) 2019/2161 (ODR II).
Easy Cancellation
You may cancel your recurring subscription at any time through your account settings on the Hub. Cancellation does not require contacting support, filling out a form, or calling a phone number. Your access continues until the end of the current billing period.
No hidden fees, early-termination penalties, or cancellation barriers apply to Consumer subscriptions.
Price Changes
We may adjust the price of your Plan, but we will provide at least 30 days’ advance notice before any increase takes effect.
If you are a Consumer and Digipa increases the price of your Plan during a prepaid subscription term (for example, an annual subscription you have already paid for), the price increase will not apply to the remainder of that prepaid term. You will have the right to cancel without penalty rather than accept the new price for subsequent billing cycles.
If you choose not to accept a price increase, you may cancel your subscription before the increase takes effect and retain access until the end of your current billing period.
