Acceptable Use Policy

What you can and cannot do with DroneDB, and how we enforce compliance.

This Acceptable Use Policy ("AUP") sets out the rules governing how you may use DroneDB Hub and related services provided by Digipa S.R.L. By accessing or using DroneDB Hub, you agree to comply with this policy. This AUP is incorporated by reference into the DroneDB Cloud Services Agreement.

1. Overview

DroneDB Hub (hub.dronedb.app) is a cloud platform for managing aerial and geospatial data, including images, orthophotos, point clouds, 3D models, digital elevation models, and related content. You may use the service for legitimate business, educational, research, and personal purposes: provided your use respects the law, respects other users, and does not abuse the platform.

Violation of this AUP may result in account suspension, content removal, or termination of your access to the service. Digipa S.R.L. will determine enforcement action at its discretion, taking into account the nature and severity of the violation, whether it is a repeat offense, and whether the violation poses a legal or safety risk.

2. Prohibited Uses: General

You must not use DroneDB Hub to:

  • Engage in unlawful activity. Any use that violates applicable laws or regulations in any jurisdiction in which you operate, or in which the Hub infrastructure is located.
  • Impersonate or misrepresent. Pretend to be another person, entity, or organization. Provide false or misleading identity information when registering or using the service.
  • Interfere with service integrity. Attempt to disrupt, degrade, or impair the availability, performance, or security of DroneDB Hub. This includes denial-of-service attacks, flooding, overwhelming systems with requests, or any pattern of excessive resource consumption that harms the service.
  • Gain unauthorized access. Attempt to access accounts, systems, networks, or data that you are not authorized to access. This includes brute-force credential attempts, session hijacking, exploitation of vulnerabilities, or circumventing access controls.
  • Distribute harmful code. Upload, disseminate, or facilitate the spread of malware, viruses, worms, Trojan horses, ransomware, or any other code or payload designed to interfere with, damage, or gain unauthorized control over systems or data.

3. Prohibited Uses: Geospatial

DroneDB Hub handles georeferenced data that can reveal precise locations, physical structures, and measurements. You must not use the service or its outputs to:

  • Conduct unlawful surveillance, stalking, harassment, or doxxing. Using geospatial data, including aerial imagery, GPS coordinates, or spatial analysis, to locate, track, or expose individuals without lawful authority or consent, where prohibited by applicable law.
  • Publish precise personal location data in violation of privacy law. Sharing or making publicly accessible geospatial datasets that contain personally identifiable location information, where doing so breaches the GDPR, Italian privacy law (D.Lgs. 196/2003 as amended by D.Lgs. 101/2018), or other applicable data protection legislation.
  • Upload unlawfully captured imagery. Processing imagery or geospatial data obtained in breach of applicable aviation law, drone (UAS) regulations, zoning restrictions, or privacy legislation. You are solely responsible for ensuring that all data you upload to DroneDB Hub was lawfully acquired and that you have the rights necessary to process, store, and share it.
  • Expose restricted or classified sites. Uploading, processing, or publishing imagery or data that reveals locations, structures, or details that are subject to legal restrictions on disclosure, including military installations, classified sites, or areas where publication is prohibited by law.
  • Falsify survey, measurement, or inspection records. Manipulating geospatial data, measurements, or derived outputs (such as DEMs, orthophotos, or point clouds) with the intent to deceive, misrepresent survey results, or create fraudulent inspection documentation.
  • Facilitate unauthorized access to or targeting of critical infrastructure. Using platform outputs to plan, enable, or assist unlawful access to, interference with, or targeting of energy, transport, water, communications, or other critical infrastructure.

4. Content Restrictions

You must not upload, process, share, or distribute content on DroneDB Hub that:

  • Is abusive, defamatory, harassing, or threatening. Material that targets individuals or groups with intimidation, threats of harm, or sustained harassment.
  • Infringes copyright or intellectual property rights. Content for which you do not hold the necessary rights, licenses, or permissions, and where your use does not fall within a lawful exception (such as fair dealing or other permitted uses under applicable law).
  • Is pornographic or sexually exploitative. Material depicting sexual exploitation, non-consensual sexual content, or illegal sexual material of any kind.
  • Constitutes hate speech or promotes violence. Content that incites hatred, discrimination, or violence against individuals or groups based on race, ethnicity, religion, nationality, gender, sexual orientation, disability, or other protected characteristics.

5. Export and Sanctions Compliance

DroneDB Hub is operated from the European Union by Digipa S.R.L., an Italian company. You are responsible for complying with the export controls, economic sanctions, and trade restrictions that apply to you and your use of the service, including but not limited to:

  • EU sanctions. Restrictive measures adopted by the European Union under Article 215 TFEU and subsequent EU sanctions regimes.
  • Italian export controls. Italian legislation implementing EU export control frameworks, including Legislative Decree 221/2017 (implementing the delegation of Law 170/2016 on export authorization procedures for dual-use products and commercial embargoes).
  • UN sanctions. Resolutions adopted by the United Nations Security Council and EU implementing regulations.
  • Download and re-export. If you download, export, or re-transmit content from DroneDB Hub to persons, entities, or jurisdictions subject to export controls or sanctions, you are responsible for verifying that such transfer is lawful.

You represent that you are not located in, under the control of, or a national or resident of any country or territory subject to comprehensive EU, Italian, or UN sanctions. If this representation changes, you must notify Digipa promptly.

6. Resource Abuse

DroneDB Hub provides storage, bandwidth, and processing resources within the limits of your subscription plan. Excessive resource consumption that exceeds plan limits or degrades service quality is not permitted. You must not:

  • Exceed plan limits. Consistently use storage, bandwidth, or processing capacity beyond what your subscription entitles you to.
  • Automated scraping or bulk downloading. Scrape, crawl, harvest, or bulk-download content from DroneDB Hub using automated tools, scripts, or bots without prior written authorization from Digipa.
  • Use infrastructure for unrelated purposes. Use DroneDB Hub compute, storage, or bandwidth for cryptocurrency mining, spam distribution, unauthorized content redistribution, or any other purpose that the infrastructure was not designed for.

7. Enforcement

Digipa will respond to violations of this AUP in a manner proportionate to the nature and severity of the violation. Available enforcement actions include, but are not limited to:

  • Warning. Issuing a written notice identifying the violation and requesting corrective action within a specified timeframe.
  • Temporary restriction. Applying temporary limitations on specific account functionality, upload capability, or shared content access pending investigation.
  • Content removal. Taking down or disabling access to specific files, datasets, or shared links that violate this policy.
  • Suspension. Temporarily suspending account access for a defined period.
  • Termination. Permanently revoking access to DroneDB Hub and terminating the Cloud Services Agreement, where violations are severe, repeated, or involve imminent legal or safety risk.

Emergency action. Where Digipa has reasonable grounds to believe that there is an imminent risk of harm, a serious legal obligation to act, or an immediate threat to service integrity, Digipa may take emergency enforcement action, including immediate suspension or content removal, without prior notice. Digipa will provide notice of such action as soon as reasonably practicable thereafter.

Repeat Infractions. Where a customer or account repeatedly violates this Acceptable Use Policy, Digipa may impose escalating enforcement measures regardless of the severity of any individual violation. Our repeat-infringer procedure follows this progression:

  • First offence: Written warning with a specified corrective action timeline.
  • Second offence within 12 months: Temporary suspension of affected functionality for a defined period (e.g., 7–30 days).
  • Third offence within 12 months: Account suspension pending review, with the possibility of termination.
  • Pattern of violations: Where Digipa identifies a persistent pattern of violations, we may terminate access immediately, with or without a cure period.

Enforcement actions are proportionate and take into account the nature, severity, and frequency of violations. Emergency action may be taken at any point where there is an imminent risk of harm or immediate legal obligation.

Reporting and Redress. To report illegal content hosted on DroneDB Hub, use our reporting procedure. Where we take enforcement action affecting your content, we will provide a statement of reasons in accordance with Article 17 of the Digital Services Act. You may appeal enforcement decisions through our internal complaint and counter-notice system described in the Illegal Content Reporting Procedure, or by contacting support@dronedb.app.

8. Safety-Critical Disclaimer

DroneDB Hub outputs, including orthophotos, digital elevation models, point clouds, 3D models, measurements, and derived analyses, are informational tools. They are not a substitute for:

  • Professional land survey, topographic survey, or geodetic measurement conducted by a licensed surveyor
  • Engineering analysis, structural assessment, or construction verification
  • Legal or regulatory compliance verification
  • Navigation or flight planning for aircraft or drones
  • Emergency response, disaster management, or public safety decision-making
  • Medical or agricultural prescription or diagnosis
  • Agronomic recommendation or crop treatment decisions
  • Safety inspections or certification

Customers and end-users of DroneDB Hub outputs are responsible for independently validating data quality, accuracy, and suitability for their intended purpose. High-consequence decisions, particularly those affecting structural safety, regulatory compliance, human safety, or financial liability, must be verified through appropriate professional channels. Digipa S.R.L. disclaims liability for damages arising from reliance on DroneDB Hub outputs without independent verification.

9. Legal Recourse and Hostile Acts

Where any person or entity intentionally targets, threatens, or undertakes acts designed to harm Digipa S.R.L., its assets, infrastructure, reputation, operations, personnel, or affiliates, Digipa S.R.L. expressly reserves all rights and remedies available under applicable law. This includes, without limitation:

  • Civil proceedings. Digipa S.R.L. may initiate civil action to seek actual damages, compensatory damages, consequential damages, and injunctive or declaratory relief. Where applicable, Digipa may seek interim measures, including asset preservation orders, site blocking, and preventive injunctions, before, during, or after principal proceedings.
  • Criminal proceedings. Where the conduct constitutes a criminal offense under applicable law, including but not limited to unauthorized access to information systems (Art. 615-ter c.p.), data and system interference (Art. 635 c.p.), computer-related fraud (Art. 640-ter c.p.), extortion (Art. 629 c.p.), threats (Art. 612 c.p.), defamation (Art. 595 c.p.), or other provisions of the Italian Criminal Code and equivalent legislation in other jurisdictions, Digipa S.R.L. will report the offense to the competent law enforcement and prosecutorial authorities and cooperate fully with any investigation.
  • Cross-border cooperation. For hostile acts originating outside Italy, Digipa S.R.L. may pursue remedies in any jurisdiction with appropriate personal or subject-matter jurisdiction, including by filing civil claims or lodging criminal complaints with the authorities of the offending party's place of residence, the location where the act was committed, or the location where damage occurred. Digipa S.R.L. reserves the right to invoke mutual legal assistance treaties, European Investigation Orders, and other cross-border enforcement instruments as applicable.
  • Indemnification. If Digipa S.R.L. incurs losses, costs, or liabilities as a result of hostile acts, violations of this AUP, or abusive use of the service by a user or third party, the responsible party shall indemnify and hold harmless Digipa S.R.L., its directors, officers, employees, and agents against all claims, damages, losses, expenses, and costs (including reasonable attorneys' fees and litigation expenses) arising therefrom.
  • Legal costs and fee-shifting. Where Digipa S.R.L. is required to engage legal counsel or incur investigative or remedial costs in response to hostile acts, the offending party shall bear all reasonable costs incurred, to the extent permitted by applicable law and court rulings.

Nothing in this section limits Digipa S.R.L.'s enforcement actions under Section 7 (Enforcement). Civil, criminal, and administrative remedies are cumulative and may be pursued concurrently or successively, as Digipa S.R.L. deems appropriate.

10. Updates to This Policy

Digipa may revise this Acceptable Use Policy to reflect changes in service offerings, applicable law, platform capabilities, or enforcement practices. Where a change is material, meaning it meaningfully alters your obligations or the enforcement framework, Digipa will communicate the update through a notice posted on DroneDB Hub, via email, or through the Cloud Services Agreement notification mechanism. Continued use of the service after notice constitutes acceptance of the updated policy.
